Terms of Service

These Terms of Service set out the rules for using our website and the basis on which we provide website design, development, and related digital services. Please read them carefully before engaging us.

Last updated: 30 October 2026

1. About these terms

These terms apply to your use of Javenstechdigital.com.au and to services provided by Javen's Tech Digital, part of the Javen's Tech family. By using our website or engaging our services, you agree to these terms. If you are agreeing on behalf of a business, you confirm that you are authorised to do so.

If a written proposal or agreement we provide conflicts with these terms, the proposal or agreement will take priority for that project.

2. Use of our website

When using our website, you agree not to:

  • use the site for any unlawful or misleading purpose;
  • interfere with the security, availability, or operation of the site, or attempt to gain unauthorised access to any systems or data;
  • copy, scrape, reproduce, or republish our content, designs, or code without our prior written permission.

We may update, change, or withdraw any part of the website at any time without notice.

3. Our services

We provide website design, web development, eCommerce development, SEO, branding, website maintenance, and ongoing digital support. The specific deliverables, timeline, and fees for your project are set out in your quote or proposal. Work that is not described there is outside the agreed scope.

4. Quotes and proposals

Quotes are based on the information available at the time and remain valid for 30 days unless stated otherwise. Timelines are estimates and depend on timely feedback, content, and approvals from you. Changes to scope, features, or requirements may require a revised quote and timeline.

5. Your responsibilities

To help us deliver your project effectively, you agree to:

  • provide accurate information and content, and ensure you have the rights and permissions to use any logos, images, text, or other materials you supply;
  • provide feedback and approvals within the timeframes agreed for the project;
  • provide access to accounts, hosting, domains, or systems we need, where relevant;
  • keep your own backups of business data and content; and
  • ensure your content and business activities comply with applicable laws.

6. Fees and payment

Fees are set out in your proposal. Invoices are payable by the due date shown on the invoice. Work may be paused or delayed if invoices are overdue. Amounts are in Australian dollars unless stated otherwise, and GST applies where required.

Third-party costs, such as domains, hosting, plugins, stock images, and paid tools, are your responsibility unless they are included in your quote.

7. Third-party services

Projects may rely on third-party platforms such as hosting providers, domain registrars, CMS and eCommerce platforms, plugins, and payment gateways. Those services are governed by their own terms and pricing. We are not responsible for outages, policy changes, or discontinuation of third-party services, though we will help where reasonably possible.

8. Intellectual property

On full payment, you own the final custom deliverables created specifically for your project, including the finished website design and content we create for you. We retain ownership of our pre-existing materials, frameworks, code libraries, templates, and know-how, and grant you a licence to use them as part of your deliverables.

Unless you ask us in writing not to, we may show completed work in our portfolio and marketing materials.

9. Confidentiality

Each party will take reasonable care to protect the other party's confidential information and use it only for the purposes of the project.

10. Warranties and outcomes

We will perform our services with reasonable care and skill. We do not guarantee specific business outcomes such as search rankings, traffic, conversion rates, sales, or revenue, because these depend on factors outside our control, including search engine algorithms, market conditions, and your own operations.

We do not warrant that third-party platforms or our deliverables will be uninterrupted or error-free. We will correct defects attributable to our work as agreed in your maintenance or support arrangement.

11. Limitation of liability

Nothing in these terms excludes or limits rights you have under the Australian Consumer Law or any other law that cannot be excluded.

To the extent permitted by law, our total liability for any claim arising out of or relating to our services is limited to the amount you paid us for the services giving rise to the claim. We are not liable for indirect or consequential loss, including lost profits, lost data, or lost business opportunities.

12. Termination

Either party may terminate a project if the other party materially breaches these terms and does not remedy the breach within a reasonable time. If you terminate, you must pay for work performed and costs incurred up to termination. We will provide the work completed to date on payment.

13. Governing law

These terms are governed by the laws of Queensland, Australia. The courts of Queensland have non-exclusive jurisdiction over any dispute arising from these terms or our services.
